PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING FAMILY TLC SERVICES OR RESOURCES. BY ACCESSING OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.

Counselling and related services are provided by Cook Social Work Professional Corporation, operating as Family TLC (“Family TLC”, “we”, “us”, or “our”).

These Terms of Use govern your access to and use of Family TLC’s website, online resources, intake systems, and counselling-related services (collectively, the “Services”). By accessing, registering for, or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.

Family TLC’s Services are not designed for crisis intervention or emergency care, and our clinicians cannot provide emergency assistance through online platforms, email, or messaging.

Privacy Policy

Family TLC’s Privacy Policy describes how we collect, use, store, and disclose personal information and personal health information in accordance with applicable laws, including the Personal Health Information Protection Act, 2004 (Ontario).

By using the Services, you acknowledge that you have read and agree to the Privacy Policy.

Counselling Services and Professional Relationship

Use of the website, completion of intake forms, or submission of information does not automatically create a counselling or therapeutic relationship with Family TLC.

Clients seeking counselling services must enter into a separate counselling agreement with Family TLC. Counselling services are provided only after intake review, consent documentation, and confirmation of service eligibility.

Family TLC may use third-party platforms to facilitate intake and administration. Information submitted through these platforms is reviewed solely for the purpose of determining whether services may be provided.

Family TLC reserves the right to decline or discontinue services at its professional discretion, subject to applicable law and ethical obligations.

Services for Children and Youth

Family TLC provides services to children and youth in accordance with Ontario law and professional standards.

Services for minors require appropriate parental or guardian consent, unless otherwise permitted by law. In certain circumstances, a child or youth may have the legal right to control access to their own personal health information.

Family TLC does not knowingly collect personal information from children under the age of 13 without appropriate consent. If such information is identified, it will be removed promptly.

Accuracy of Information

You agree to provide accurate, current, and complete information during intake and throughout your engagement with Family TLC. You are responsible for notifying us of any changes to your contact or personal information.

Family TLC may contact you to verify information and reserves the right to refuse or suspend services if information is incomplete or inaccurate.

Telehealth and Electronic Communication

Services may be provided in person or through telehealth and electronic communication platforms.

You acknowledge that:

  • electronic communication carries inherent privacy and security risks;
  • no method of electronic transmission is completely secure;
  • technical disruptions may occur.

By using telehealth services, you agree to provide informed consent through a separate telehealth consent form.

Intellectual Property

All content on the Family TLC website, including text, graphics, logos, and software, is owned by or licensed to Family TLC and is protected by Canadian and international intellectual property laws.

You may not copy, reproduce, distribute, modify, or use any content without prior written consent, except as permitted by law.

All third-party trademarks and content remain the property of their respective owners and do not imply endorsement by Family TLC.

Availability of Services

Family TLC does not guarantee uninterrupted access to the Services. Access may be limited, suspended, or terminated due to maintenance, technical issues, or circumstances beyond our control.

Family TLC reserves the right to deny access to the Services at its sole discretion, subject to applicable law.

Transmission of Information

Family TLC is not responsible for the security of information transmitted over the internet or other networks outside of our control.

You acknowledge that any information you transmit electronically is done at your own risk. Family TLC is not responsible for data loss or interception during transmission.

Disclaimer of Warranties

The Services and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied.

Family TLC does not warrant that the Services will be error-free, uninterrupted, or suitable for your specific needs.

Limitation of Liability

To the fullest extent permitted by law, Family TLC and its directors, officers, employees, contractors, and clinicians shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

In no event shall Family TLC’s total liability exceed the fees paid by you to Family TLC during the three (3) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Family TLC from any claims, damages, liabilities, costs, or expenses arising from:

  • your use of the Services;
  • your breach of these Terms;
  • your violation of applicable laws or third-party rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.

Dispute Resolution and Arbitration

Except where prohibited by law, any dispute arising from these Terms or the Services shall be resolved through binding arbitration conducted in Ontario, Canada, before a single arbitrator, in accordance with applicable arbitration laws.

Class Action Waiver

To the extent permitted by law, you waive any right to participate in a class action or representative proceeding against Family TLC.

Termination

These Terms remain in effect until terminated. Termination of counselling services occurs in accordance with the applicable counselling agreement.

Family TLC may retain information as required by law, professional standards, or legitimate business purposes.

Electronic Acceptance

By submitting information through Family TLC’s intake forms or online systems, you consent to conducting transactions electronically and acknowledge that such submission constitutes your electronic signature.

Changes to These Terms

Family TLC reserves the right to modify these Terms at any time. Changes are effective upon posting to the website.

Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Assignment

You may not assign your rights under these Terms without written consent. Family TLC may assign its rights without restriction.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Family TLC regarding use of the Services.

Family TLC is inclusive of all cultures, faiths, gender identities, and sexual orientations.
